The Intellectual Property Act No. 36 of 2003 governs trademark registration, enforcement, opposition, and cancellation.
No. A search is not mandatory, but it is strongly recommended to assess refusal and opposition risk.
Yes. NIPO now provides public online access to trademark records through a WIPO-hosted search portal. However, this is a search facility only. Full online trademark filing is not yet available, and professional clearance searches remain advisable.
Sri Lanka uses the Nice Classification. Each application must be filed per class.
Yes, but separate applications are required for each Nice class.
Yes. In practice, NIPO does consider well-known and foreign marks, including those visible in WIPO databases, when assessing similarity and likelihood of confusion.

No. Sri Lanka is not currently a member of the Madrid System. This means you cannot yet file a Madrid international application that designates Sri Lanka through WIPO; national filing at NIPO is required.
Yes. Sri Lanka has taken steps toward accession, including government approval and draft legislation to amend the IP Act. However, no official implementation date has been announced.
