Trademark filing services involve professional work and official fees that are typically non-refundable once incurred, consistent with international trademark practice.
Refund Before Filing
A refund may be considered prior to filing only if:
- The application has not been filed with NIPO and no substantive work has been undertaken
- The client provides written notice of cancellation within 24 hours of payment
Any such refund shall be subject to deduction of bank charges, payment gateway fees and any third-party costs already incurred.
Refund for Failure to File
If we fail to file the trademark application with NIPO within 21 days from the date of receipt of full payment, a refund of the professional fees may be requested, provided that the delay is not caused by incomplete information or client inaction.
No Refund After Filing
Once the trademark application has been filed with NIPO:
- Official fees are non-refundable
- Professional fees are non-refundable
This applies regardless of refusal, objection or opposition.
Partial Refunds
Where applicable, refunds may exclude:
- Government fees
- Third-party charges (e.g., translation, courier, sworn translator fees)
- Work already performed
Duplicate or Erroneous Payments
Refunds may be issued in cases of:
- Duplicate payment
- Overpayment
- Technical payment errors
Refund Processing
Approved refunds will be processed through the original payment method within a reasonable timeframe.
